TERMS OF SERVICE (DIGITAL PRODUCTS)
1. General Provisions
• These Terms of Service (the "Terms") govern the purchase of HTML email templates (the "Products") and the use of the online customizer (the "Customizer") via the website StayTemplates (the "Website").
• The seller and owner of the Website is InProgress Paulina Brzeźniak, with its registered physical address at: Okrężna 37C/11, 58-100 Świdnica, Poland, VAT ID / Tax Number: PL8842500931 (hereinafter referred to as the "Seller").
• Contact details of the Seller: Email: info@staytemplates.com.
• By placing an order on the Website, the Buyer (a natural person, business entity, or hotel operator) agrees to these Terms.
2. Technical Requirements
To successfully purchase, customize, and use the Products, the Buyer must meet the following minimum technical requirements:
• A device (computer, tablet, or smartphone) with active Internet access.
• An up-to-date web browser (e.g., Google Chrome, Safari, Mozilla Firefox, Microsoft Edge) supporting HTML5 and JavaScript.
• An active email address to receive order confirmations and delivery links.
• A third-party system capable of importing, editing, and sending custom HTML/CSS email codes (such as a Property Management System – PMS, Hotel CRM, Channel Manager, or email marketing software like Mailchimp, ActiveCampaign, etc.).
3. Subject of Transaction & Delivery
• The Products available on the Website are digital contents consisting of customizable HTML/CSS code templates designed for lodging and hospitality communication.
• No physical goods or storage devices are shipped.
• The transaction is processed as a guest purchase (no user registration required).
• Upon successful payment processed via our merchant of record, Paddle, the Buyer will immediately receive access to a unique link redirecting them to the Customizer and/or a direct download link for the purchased Product(s).
4. License and Permitted Use
• Upon payment, the Buyer is granted a non-exclusive, perpetual, worldwide, non-transferable license to use the purchased HTML template.
• The Buyer is permitted to use the template solely for their own internal business operations (e.g., for automated or manual communication with guests of their own lodging facility, hotel, guesthouse, or rental apartments).
• Strictly Prohibited: The Buyer is not allowed to resell, sub-license, distribute, share, lease, package, or publish the raw HTML/CSS code, modified variations, or template files to any third party, online marketplaces, or public platforms.
5. Refund Policy & Right of Withdrawal
• The Products sold on the Website are digital contents not delivered on a tangible medium.
• Important Notice: Due to the digital and instant delivery nature of the Products, by completing the purchase and explicitly consenting to receive the digital content immediately after payment, the Buyer acknowledges and agrees that they lose their statutory right of withdrawal (the right to a 14-day refund). Consequently, all sales are final and non-refundable.
• Download link validity: Each order includes a unique download and customizer link that stays valid for 12 months from the purchase date. After this period the link is permanently invalidated. The Buyer is responsible for downloading and archiving their HTML files within this window. The Buyer can also re-request delivery to the original email address within the first 30 days via the "Resend download link" page.
• Version of these Terms: The version identifier of these Terms and the Privacy Policy accepted by the Buyer at checkout (e.g. v2026-07-15) is recorded on the order. Every prior version is available as an immutable snapshot at the permalink /terms/{version} and /privacy/{version}. Future amendments to these Terms do not retroactively apply to purchases made under an earlier version.
6. Conformity of Digital Content & Technical Disclaimer
• The Seller delivers the Product in conformity with the contract at the time of delivery. The templates are single-purchase files; the Seller does not have an obligation to provide ongoing automatic updates or future compatibility upgrades unless explicitly agreed otherwise.
• The HTML templates are tested to render correctly in modern, standard email clients. However, due to rendering variations among various email service providers (especially legacy desktop clients like older versions of Microsoft Outlook or specific local webmail systems), the Seller does not guarantee identical visual rendering across all possible email software.
• The Seller is not liable for layout breaks or malfunctioning codes resulting from: (1) modifications made to the HTML code by the Buyer, (2) incorrect manual integration of the code into the Buyer's PMS, CRM, or channel manager software.
• The Products and Customizer are provided on an "as is" and "as available" basis.
7. Payments and Billing
• Our order process is conducted and managed by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles all customer service inquiries, tax calculations (including VAT), invoicing, and billing.
• Prices are displayed on the Website in selected currencies (PLN, EUR, USD, etc.) and are final (inclusive of taxes where applicable, subject to Paddle's checkout calculation).
8. Complaints, Support, and Dispute Resolution (ODR)
• Any technical issues or complaints regarding the download, customization, or functionality of the templates should be reported via email to: info@staytemplates.com.
• The Seller will review and respond to complaints within 14 calendar days from receipt.
• European Union consumers have the right to resolve disputes out-of-court via the online platform provided by the European Commission (ODR). The platform is accessible at: http://ec.europa.eu/consumers/odr/.
9. Final Provisions
• These Terms are governed by the laws of Poland.
• In the case of Buyers who are not consumers (B2B clients), any disputes arising out of or in connection with these Terms shall be resolved solely by the competent court having jurisdiction over the Seller's registered seat.
10. Optional Custom Services (Customization & Bespoke Design)
• In addition to the ready-made templates, the Seller offers on-request paid services: (a) Template Customization — modifications of an existing template to the Buyer's brand/content; (b) Custom Design — bespoke email template built to the Buyer's brief.
• Requests are submitted via the forms provided on the Website. Every submission receives a unique reference number (e.g. REQ-2026-0001).
• Each request is reviewed individually. The Seller issues a written quote by email; work starts only after the Buyer pays the quoted price via a private Paddle payment link sent by the Seller.
• Delivery timeline: The Seller uses reasonable efforts to deliver custom work promptly. However, the Seller does NOT guarantee any deadline — turnaround depends on the current queue and the scope of the request. Any indicative timeline shared during quoting is non-binding.
• Once a custom service is paid and work has begun, the Buyer expressly consents to immediate performance and waives the 14-day right of withdrawal for that custom service in the same way as for template purchases. Custom services are non-refundable once work has started.
• Deliverables of custom services follow the same license terms as regular templates (Section 4).
• Support for custom deliverables is provided by email at info@staytemplates.com within the same complaint window as regular Products.
11. Request Thread & Uploaded Materials
• After submitting a customization or custom-design request, the Buyer receives a private thread link (URL containing a unique token). The link is valid for 90 days from the request date; after that period the thread and any attachments become inaccessible via the link and are scheduled for deletion.
• Through the thread the Buyer may exchange messages with the Seller. For template customization requests, the Buyer may also upload materials (logos, moodboards, reference images) subject to the following limits: max 2 files per message, 3 MB per file, 6 MB per message, and 15 MB / 10 files in total per thread. Allowed file types: JPG, PNG, WebP, SVG only. Archives (e.g. ZIP, RAR) and executables are not accepted. For custom-design (bespoke) requests, in-thread file uploads are DISABLED — the Buyer shares brand assets, photos and reference materials by sending a WeTransfer, Google Drive or Dropbox link inside a message. Larger files for any request type should always be shared via such an external link.
• The Buyer represents that they own the uploaded materials or hold all necessary rights and permissions to share them with the Seller for the purpose of preparing the requested work. The Buyer grants the Seller a non-exclusive licence to use the materials solely to prepare and deliver the requested customization or custom-design.
• The Buyer must not upload: content infringing third-party rights, unlawful, defamatory, harmful, or containing personal data of the Buyer's own guests or third parties unless strictly necessary and disclosed with a valid legal basis under GDPR.
• The Seller may remove any uploaded content that violates the above rules, refuse to continue a request, and — in serious cases — terminate the request without refund of already-completed work.
• Attachments are stored on our infrastructure in a private, non-public bucket. Individual signed links to download attachments expire within minutes and are re-issued on demand from the thread page.
